Terms of Service

1. Overview

TNNS Head is a brand operated by Tennis Head LLC, a California limited liability company (“Tennis Head,” “TNNS Head,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) are a binding legal agreement between you and Tennis Head LLC. They govern your use of our website, mobile applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. We may update these Terms at any time by posting a revised version on our website. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility and Accounts

To use the Service, you must be at least 18 years of age. If you are under 18 years of age, your parent or legal guardian must consent to these Terms, to our Privacy Policy and to your access to and use of the Service, as well as to the collection and use of your User Content (as defined below), by completing and returning the parental consent form. If you are younger than 18 but over 13 years of age and are an emancipated minor you will be required to complete the consent form and provide evidence of your status as an emancipated minor. Children under 13 may use the Service only through an account created and managed by a parent or legal guardian who provides verifiable consent. You are responsible for maintaining your account credentials and for all activity under your account. Notify us immediately at legal@tnnshead.com of any unauthorized use.

3. Service Scope

The Service includes our website, mobile applications, and other digital offerings.

These Terms apply to your use of TNNS Head across all platforms, whether in existence now or developed in the future.

4. Payments, Subscriptions, and Refunds

Subscription Fees

Subscriptions renew automatically each billing cycle. You may cancel anytime effective at the end of the current billing period. Subscription fees are non-refundable.

Merchandise Refunds

Physical merchandise purchased through our Service may be eligible for refunds in accordance with our then-current Refund Policy. To request a refund, contact legal@tnnshead.com. We may update or modify refund practices at any time.

Payments are processed by third-party payment providers, and by submitting payment information you agree to their respective terms of service.

5. User Content

You retain ownership of all videos, data, and materials you upload (“User Content”). By uploading User Content, you grant Tennis Head LLC a non-exclusive, fully-paid, worldwide, royalty-free, sublicensable license to use, host, store, reproduce, modify, create derivative works (such as translations, adaptations or changes we might make for the Service to function optimally), communicate, publish, publicly perform, publicly display and distribute your User Content solely to operate, promote, maintain, and improve the Service.

Plain English: You give us permission to use any content you provide through the Service. We use this in connection with operating the Service and you also affirm that you have the legal right to let us use the content you provide.

Your uploaded videos and other User Content will be viewable only by you and, if applicable, your linked parent or coach accounts within the platform. We will not publicly display, sell, distribute, or use User Content for marketing without your explicit permission.

We may internally review User Content for quality assurance, system improvement, or technical support, but only within the Service. You agree that your User Content will not (a) be libelous, defamatory, obscene, pornographic, abusive, threatening, or otherwise inappropriate; (b) advocate or encourage conduct that could be a criminal offense, create civil liability, or otherwise violate any applicable federal, state, local or foreign law or regulation; (c) advertise or otherwise solicit funds, goods, or services; or (d) infringe on the copyright, trademark, right of publicity or other intellectual property rights of others.

Plain English: If you post or upload any User Content to our Service, make sure you own it and that it doesn’t violate anyone’s rights or the law.

6. AI-Powered Features

Our Service uses AI-powered technologies from third-party providers, including but not limited to OpenAI, Anthropic, Google, and others.

By using these features, you consent to your data being processed through these systems and agree to comply with their respective terms of service, which may change independently of ours.

AI-generated insights are for informational and educational purposes only and are not professional coaching or medical advice. We make no guarantee of accuracy, completeness, or suitability of AI outputs.

7. Third-Party and Public Data

Our Service may display information obtained from various public or licensed sources. These sources may change or expand over time, and by using the Service you agree that such integrations are governed by these Terms, or the applicable terms and conditions and privacy policy of any other website or source.

We do not control or guarantee the accuracy, completeness, or availability of third-party data.

We are not responsible for any acts or omissions of third parties, such as advertiser, linked party, or any other party providing services to the site or to you. We are also not responsible for any “hackers” or for those who might disrupt or alter the site or take or alter material you provide.

8. Acceptable Use

You agree not to:

  • Upload illegal, harmful, or infringing content;
  • Violate any laws or third-party rights;
  • Attempt to access, copy, or reverse-engineer our software or AI systems;
  • Interfere with or disrupt the Service;
  • Provide false or misleading information about yourself or others using the Service;
  • Introduce any virus, trojan horse, or other malicious or harmful code;
  • Modify or change any aspect of the Service;
  • Collect or store personal data about other persons on the Service;
  • Violate any security features of the Service, such as accessing content or data not intended for you, or logging onto a server or account you are not authorized to access;
  • Probe, scan, or test the vulnerability of the Service, or any associated system or network, or breach security or authentication measures without proper authorization;
  • Disable, overburden, or impair the proper working or appearance of the Service, such as engaging in a denial of service attack or interfering with page rendering or other functionality;
  • Modify, reverse-engineer, decompile, disassemble, or otherwise reduce to a human-perceivable form any of the source code used in providing the Service;
  • Collect users’ content or information, or otherwise access the Service, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission;
  • Solicit login information or access an account belonging to someone else; or
  • Facilitate or encourage any violations of these Terms or our policies.

We may suspend or terminate your access for violations of these Terms.

Plain English: Please use common sense and common courtesy when using our Service. Don’t do anything that is going to ruin it for other people.

9. Intellectual Property

Except for User Content, all materials in the Service—including but not limited to code, design, text, and branding—are owned by Tennis Head LLC. “TNNS Head” and associated logos are trademarks of Tennis Head LLC. You may not use them without written permission.

The Service may also contain information and materials owned by third parties and you are not permitted to use such materials without the prior and written permission of the owner.

We are happy to hear from our users and welcome feedback regarding our Service. If you do send any unsolicited submissions to us, those submissions become our property and may be used as we see fit without any compensation, credit, or notice to you. By sending an unsolicited submission you waive the right to make any claim relating to our use of such submission.

10. Termination

You may stop using the Service at any time.

We may modify, suspend, or terminate your access, with or without notice, if you breach these Terms or if continued use poses risk to us or others. None of these actions will result in any liability to us.

11. Disclaimers

The Service is provided “as is” and “as available.” We do not warrant that any use of the Service will be secure. You are using the Service at your own risk. We do not warrant that the Service will meet your requirements or that the operation of the Service will be uninterrupted or error-free. We make no claim, promise or guarantee about the accuracy, completeness, or adequacy of the information contained in or linked to the Service.

We make no express or implied warranties, including merchantability, fitness for a particular purpose, or non-infringement. We are not liable for injuries or damages arising from sports activities or reliance on AI-generated content.

Plain English: This means that you use the Service as it is. Of course, we try our best to make sure the Service is secure, that it will function properly and that there won’t be errors in the information we provide, but we can’t guarantee it. We may provide information on the Service that sounds like advice. Each person’s situation differs, so you should always consult your own advisors rather than relying on general information on the website.

12. Limitation of Liability

To the fullest extent permitted by law, Tennis Head LLC and its affiliates will not be liable for direct, compensatory, special, punitive, indirect, incidental, or consequential damages, including lost profits, data, or goodwill.

Tennis Head LLC’s total aggregate liability shall not exceed $100 or the amount you paid in the preceding 12 months, whichever is greater. This limitation will apply regardless of the foreseeability of those damages and regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action. These disclaimers and limitations may be limited by the laws of certain jurisdictions and are applicable to the extent permitted by law.

Plain English: Your use of the site is at your own risk and we cannot be held responsible financially for damages you incur through the Service in excess of what is stated above, unless the law says otherwise.

13. Indemnification

You agree to indemnify and hold harmless Tennis Head LLC, its employees, and partners from any claims or liabilities arising from (1) your use of the Service; (2) the use of any User Content or information you provide; (3) information or material provided through your account, even if not posted by you; and (4) your violation of these Terms.

14. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflicts-of-law principles.

Any dispute arising under these Terms shall be resolved by binding arbitration administered by JAMS under its Consumer Arbitration Rules in Los Angeles County, California.

If arbitration is opted out or found unenforceable, disputes will be resolved exclusively in the state or federal courts of Los Angeles County, California.

You and Tennis Head LLC waive the right to a jury trial or class action to the furthest extent permitted by law.

15. Entire Agreement

These Terms constitute the entire agreement between you and Tennis Head LLC and supersede all prior agreements relating to the Service.
